Welcome to BrainPetals.
BrainPetals is a private journaling experience that turns your entries into a growing virtual garden. These Terms of Use govern your access to and use of BrainPetals.
By creating an account, you agree to these Terms. BrainPetals records the version of the Terms you accepted and when you accepted them.
1. Using BrainPetals
You may use BrainPetals for lawful personal purposes and in accordance with these Terms.
You are responsible for the journal entries and other content you choose to create through your account.
You may not use BrainPetals to:
- violate applicable law;
- interfere with or attempt to compromise the security or operation of the service;
- attempt to access another user's account, journal, or data;
- probe, attack, overload, or disrupt the service or its infrastructure;
- use automated systems to abuse or improperly access the service.
2. Your Journal Belongs to You
You retain ownership of the journal entries and other original content you create in BrainPetals.
You do not transfer ownership of your writing to us by using the service.
You give BrainPetals only the limited rights necessary to store, process, retrieve, and display your content back to you and otherwise operate the service.
We do not claim ownership of your journal.
3. Privacy
Your use of BrainPetals is also subject to our Privacy Policy, which explains what information we collect and how it is handled.
Your journal is intended to be private to your account.
BrainPetals does not currently offer a feature that makes journal entries public or shares them with other users.
We do not use your journal entries for advertising or to train artificial intelligence models.
4. Your Account
BrainPetals uses passwordless email authentication. No BrainPetals password is created or stored.
You are responsible for maintaining control of the email account you use to access BrainPetals. Anyone who gains access to your email may potentially be able to request a sign-in link for your BrainPetals account.
Please contact hello@brainpetals.com if you believe your account has been accessed without authorization.
5. Age Requirements
You must be at least 13 years old to create a BrainPetals account.
When creating an account, you will be asked to confirm that you meet the applicable minimum age requirement.
If the laws where you live require you to be older to consent to an online service or the processing of your personal information, the applicable higher age requirement may apply.
6. Your Content
BrainPetals is a journal. We understand that journals can contain personal, emotional, difficult, or sensitive thoughts.
You are responsible for deciding what you choose to record.
BrainPetals does not provide medical, mental-health, legal, financial, or other professional advice. Features, prompts, visual elements, moods, music, weather effects, or other aspects of the experience should not be interpreted as professional advice, diagnosis, assessment, or treatment.
7. Intellectual Property
BrainPetals's software, design, visual elements, branding, illustrations, garden system, interface, music or audio owned by BrainPetals, and other original product materials are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of BrainPetals's intellectual property to you.
Your own journal writing remains yours.
8. Availability and Changes
BrainPetals is an evolving service.
Features may be added, changed, removed, interrupted, or discontinued as the product develops.
We will make reasonable efforts to operate BrainPetals reliably, but we cannot guarantee that the service will always be available, uninterrupted, error-free, or compatible with every browser or device.
9. Exporting Your Journal
BrainPetals allows you to export your journal as readable text or raw data.
Because journal entries may be personally important or irreplaceable, we encourage you to export information you particularly want to preserve.
BrainPetals should not be treated as the sole permanent archive of irreplaceable information.
10. Deleting Your Journal or Account
You may empty your garden without deleting your account. Doing so permanently removes the journal entries associated with your garden from the active database.
You may also delete your BrainPetals account. Account deletion removes your account together with its associated gardens, journal entries, and profile information from the active service.
BrainPetals provides an opportunity to export your information before account deletion.
Deletion from the active database is immediate and irreversible.
BrainPetals's hosting provider maintains rolling daily database backups for seven days. Information deleted from the active database may therefore remain in an existing backup for up to seven days before it is permanently removed from those backups.
11. Suspension or Termination
We may restrict or terminate access to BrainPetals if an account is used to attack, abuse, compromise, or unlawfully interfere with the service or other users.
If BrainPetals itself is discontinued, we will make reasonable efforts to provide advance notice when practical and, where feasible, an opportunity to export journal information.
12. Third-Party Services
BrainPetals relies on limited third-party infrastructure and services to provide hosting, authentication, email delivery, and optional weather information.
Those services may experience interruptions or changes outside our control.
Our Privacy Policy provides more information about the service providers that process personal information.
13. No Guarantee of Permanent Storage
Although BrainPetals is designed to preserve your journal entries, no online service should be treated as the only permanent archive of irreplaceable information.
We do not guarantee that data will never be lost because of technical failure, security incidents, service interruption, events outside our reasonable control, or other unforeseen circumstances.
We encourage you to use BrainPetals's export feature for entries you consider irreplaceable.
14. Disclaimer
BrainPetals is provided on an "as is" and "as available" basis to the extent permitted by applicable law.
We make no guarantee that BrainPetals will meet every user's needs or that every feature will always operate without interruption or error.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer-protection law.
15. Limitation of Liability
To the maximum extent permitted by applicable law, BrainPetals and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
16. Changes to These Terms
We may update these Terms as BrainPetals evolves.
If a change materially affects your rights or obligations, we will provide reasonable notice where required.
Where appropriate, BrainPetals may ask you to accept a new version of these Terms before continuing to use the service.
17. Governing Law
The governing law applicable to these Terms will be determined before BrainPetals is offered as a commercial service.
Nothing in these Terms is intended to deprive you of consumer-protection rights that apply to you under applicable law.
